This is a must-have book for anyone who practices photography as a hobby or profession. It details when and where you can legally take photographs (aka rights and responsibilities). I discovered the topic as a hobby photographer, when planning a trip to take photos at certain state wildlife refuges. Nobody thinks twice about someone pulling out their phone and taking a touristy snapshot, but set up a tripod and all of a sudden legal issues start popping up. Knowing your legal rights as a photographer (whether a hobby or pro) is pretty darned important. If you are investing big bucks in cameras, spend a few dollars more and learn about the legal side - when and where you can legally take pictures, when you might need a permit, etc. Did you know that taking photos of pigeons on statues in a park could be problematic? I didn't. Clearly there is more to photography than a pretty picture.
Excellent introduction to law and photography, should be considered "required" reading for every aspiring professional photographer. While not an exhaustive resource or substitute for an Attorney, it will establish a foundation of knowledge so that you'll know what you don't know, and where to look to find out. It will get you ready to speak with an Attorney (you do have one, right?) so you'll know what questions to ask and what needs to be covered for your business needs.
I found Krages' book readable, entertaining, informative, and useful. Even after pursuing photography as a hobby for decades, Krages was able to clear up myths and misconceptions I'd long held. I've purchased several copies to "lend" to photographers I'm mentoring.Pros- easy to read- covers a wide breadth of subjects- includes sample legal forms- includes very useful explanationsCons- should include more information about recording video since that's built in to so many cameras now- case law is changing rapidly, so I'd appreciate periodic supplements by state rather than whole new editionsSummaryIf there's a better and more current legal handbook for photographers available, I haven't seen it.
In today's world photographers are often questioned or confronted with what they are doing. More overzealous people exist today, including a few law enforcement or security officers trying to protect perceived rights or restrictions. The overzealous protectors, coupled with many photographers who do not understand when it is appropriate to tactfully address the situation or simply move on, could effectively reduce our ability to photograph what is currently within our rights, morals, and ethics.Bert P. Krages lays out what is clear, not so clear and pure myths. He provides guidance on how to deal with certain circumstances and the reasoning for doing so.Photographers also need to be concerned with protecting the rights to their photographs and knowledgeable enough not to practically give away their rights. Along with being concerned for the content and privacy of others when appropriate.The book covers almost every situation a photographer needs to be concerned with and provides specific examples.
As a professional photographer and writer for many years, I have occasionally bumped into problems related to making or using photographs -- people who tell you that you can't make a photograph, people who use your photographs without permission -- and I found Bert's first edition of this book several years ago and was delighted with its contents. His model-release form, for example, is the most simple and un-intimidating I have ever seen, and getting a signed model release is required for some of the work I do. I thought the advice generally was superb -- so much so that I bought copies of the book for everybody in our little company.Since then we have worked with Bert on many copyright infringement problems, always successfully, and some of that experience has been incorporated into this second edition of the Handbook. There is tremendous misunderstanding about how the Copyright Act works and what a photographer must do to get full protection -- formal registration -- and what a photographer can get when a registered image is infringed. Bert knows this topic inside and out and shares that information in this book.If you are a photographer who plans to keep from being sued, arrested, or harassed, and if you want to know what your options are when somebody uses your work without permission, Bert's LEGAL HANDBOOK is great advice at very reasonable expense. If you're a professional photographer you must have this book. If you're an amateur photographer or even just a casual "snapshooter" who takes some occasional weekend shots, you must have this book. It will keep you from running afoul of the laws regarding photography, and most importantly it will define your rights as a photographer and help you to stand up for them when challenged by those who think they might be in the know but really aren't, and surprisingly enough this can include law enforcement personnel! I was surprised at and pleased with the information I learned from this book. Bookmark and highlight relevant passages and take this book into the field with you if you think you may encounter resistance to your legal rights to shoot. I'm ordering a second copy in order to do just that very thing. Highly recommended!
